1. Agreement

 

By downloading or using the GymVoice  app ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

 

 

2. The Service

 

GymFloor AI provides AI-generated workout suggestions, exercise guidance, and gym floor navigation. The App is a fitness planning tool only. It does not provide medical advice, physiotherapy, rehabilitation, or clinical health services.

 

 

3. Health and Safety — Important Disclaimer

 

READ THIS CAREFULLY.

 

By using GymFloor, you acknowledge and agree to the following:

 

Consult a doctor before starting any exercise programme, particularly if you have any medical conditions, injuries, or health concerns.

 

GymFloor AI generates workout suggestions based on general fitness principles and your stated preferences. These are not tailored medical or physiotherapy advice.

 

Exercise carries inherent risk, including but not limited to: muscle injury, joint injury, cardiovascular events, and falls. You assume all risk associated with your use of the App and any exercise you perform.

 

We are not responsible for any injury, illness, or harm — including death — arising directly or indirectly from use of the App, following workout suggestions, or performing any exercise.

 

It is your responsibility to exercise within your ability, use correct technique, use appropriate equipment, and stop immediately if you feel pain, discomfort, or dizziness.

 

The AI-generated coaching cues and form guidance are illustrative only. Always seek qualified in-person instruction for new or complex exercises.

 

 

4. No Warranties

 

The App is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to:

 

Fitness for a particular purpose

Accuracy or completeness of workout suggestions

Uninterrupted or error-free operation

Results from following any workout or exercise plan

 

We do not guarantee that any exercise programme will achieve specific fitness goals.

 

 

5. Limitation of Liability

 

To the fullest extent permitted by applicable law:

 

GymFloor AI Ltd, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from your use of the App.

 

This includes but is not limited to: personal injury, property damage, loss of data, loss of income, or any other loss.

 

Our total aggregate liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or £50, whichever is greater.

 

Nothing in these terms limits liability for death or personal injury caused by our gross negligence, or for fraud — as required by UK law.

 

 

6. Your Responsibilities

 

You agree that you will:

 

Use the App only for lawful personal fitness purposes

Not copy, distribute, modify, or reverse engineer the App

Not use the App to provide commercial fitness services to others without our written consent

Provide accurate information during onboarding

Take sole responsibility for how you perform exercises suggested by the App

 

 

7. HealthKit and Health Data

 

If you grant access to Apple HealthKit, you authorise us to read fitness data to personalise your experience. We do not store HealthKit data on our servers. You can revoke this access at any time via iOS Settings.

 

 

8. Push Notifications

 

You may receive workout reminders and motivational messages. You can disable these at any time in the App or in iOS Settings.

 

 

9. Subscription and Payments

 

If the App offers paid features, payment terms will be presented at the point of purchase. All purchases are subject to Apple's App Store terms.

 

 

10. Termination

 

We may suspend or terminate your access if you breach these Terms. You may stop using the App at any time. On termination, you may request deletion of your data per our Privacy Policy.

 

 

11. Governing Law

 

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

 

 

12. Changes

 

We may update these Terms. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.

 

13. Referral Programme

The GymFloor referral programme is operated by Tolt. By participating, you agree to Tolt's terms and conditions in addition to these Terms of Use.

You earn a £199 commission for each gym that signs up and pays the mapping fee using your unique referral code. Commission is made available to claim via your Tolt account within 15 days of GymFloor receiving the gym's mapping fee payment. All payments are claimed directly through Tolt. GymFloor does not handle or process referral payments.

Self-referrals, fraudulent referrals, and referrals that result in a chargeback or dispute are disqualified. GymFloor reserves the right to modify or discontinue the referral programme at any time, with 30 days' notice to active participants.
